Summary
The OFT has prepared a set of principles to apply when working with its partners, including self-regulatory bodies, to maximise compliance with the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) and the Business Protection from Misleading Marketing Regulations 2008 (BPRs). The policy seeks to encourage bodies such as OFT Approved code sponsors and other trade associations to act as a first port of call for resolving compliance issues in addition to recognised statutory bodies such as the Advertising Standards Authority (ASA) and PhonepayPlus. It looks at alternative ways of bringing about compliance outside of the traditional statutory framework for enforcing the law. Rather than dealing with matters always through the criminal or civil courts, we will look to other bodies, which we refer to as our compliance partners, with tried and tested systems for dealing with non-compliance.
The OFT launched a consultation on 11 December 2008 which closed on 5 March 2009. See further information on the consultation page. The principles form part of the OFT's response to this consultation (pdf 367kb).
